I'm not sure how you sue someone who is doing something they have a legal right to do. I can't say I'm surprised, though. I've been expecting to hear about this sort of suit for a while. Back when I worked in property management, I was daily in expectation of being sued by tenants because of smoke from neighboring units, regardless of the fact I was legally unable to restrict smokers from moving in, and physically unable to completely hermetically seal a unit which is what would have been necessary to keep smoke from coming in.
